By accessing or using our services, you agree to comply with and be bound by the following Terms of Service, as well any other policies outlined in our website. If you do not agree with any of these terms, do not use our services.
1. Acceptance of Terms
By accessing or using GigHelper, you agree to these Terms of Service, and all other policies and agreements referenced herein. You must accept these terms to use our platform, and your acceptance is required during your first sign up.
2. Eligibility
To use GigHelper, you must be at least 18 years old. By registering for an account, you confirm that you meet this age requirement.
3. Account Registration
To access GigHelper's services, you must first be being invited to our Discord server by another GigHelper member or staff. For that you need to register for a Discord account. Discord is a third-party service which is required to access our website. You are responsible for maintaining the confidentiality of your account credentials and for any activities conducted through your account.
4. Service Description
GigHelper offers a suite of tools designed to automate tasks for delivery app drivers. These services aim to increase efficiency but must be used in compliance with local laws and platform guidelines.
5. User Conduct
5.1 General Conduct
Users must not share login credentials under any circumstances. While using GigHelper, you agree to:
- Comply with all applicable laws and regulations.
- Avoid any form of harassment, spamming, or abuse of other users.
- Maintain professionalism and respect in all interactions, including our Discord server and any public posts on the website.
5.2 Community Conduct
GigHelper members must be part of the Discord server for the tool to function, support and community interaction. Users must maintain professional and respectful conduct at all times, adhering to community guidelines.
6. Payment Terms
GigHelper operates on a subscription payment system. Users subscribe via Stripe (our payment processor). Subscriptions last for a set amount of time, and your access to our tools will be cut immediatelly as the subscription expires if you do not renew it. The renewal process can be automated through Stripe.
Refunds: All sales are final, except in select cases in a case-by-case basis by GigHelper staff.
7. Intellectual Property
GigHelper's software and web client are protected under intellectual property laws. Users are prohibited from altering or distributing our software without explicit permission from GigHelper staff.
8. User-Generated Content
All user-generated content, including product reviews, community posts, and profile pictures, must comply with the conduct guidelines specified above. GigHelper reserves the right to remove any content deemed inappropriate, with or without notice.
9. Account Termination
GigHelper reserves the right to terminate user accounts for violations of these Terms of Service or any form of abuse, including exploiting bugs or glitches in our software. Penalties will be determined on a case-by-case basis and may vary.
Since GigHelper accounts are directly linked to the user's Discord account, users may terminate their accounts at any time by deleting their Discord account in the Discord app settings.
Warning: This action is not reversible and will cause immediate account termination. Any ongoing services or remaining subscription duration will be lost without the possibility of full or partial refund.
10. Limitation of Liability
By using GigHelper, you expressly acknowledge and agree to the following:
a) Third-Party Platform Policies: Our services may conflict with or violate the policies of third-party gig work platforms. GigHelper is not responsible for any repercussions to your accounts on such platforms due to the usage of our tools.
b) Financial Outcomes: GigHelper does not guarantee increased income from using our tools. We suggest potential benefits as possibilities rather than certainties.
c) Service Availability: We do not guarantee uninterrupted, timely, secure, or error-free operation of our services. GigHelper shall not be liable for any service interruptions, delays, failures, or data loss.
d) Maximum Liability: In no event shall GigHelper's total liability exceed the amount paid by you to GigHelper during the month preceding the event giving rise to such liability, or USD $100, whichever is less.
e) Indirect Damages: GigHelper shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses.
f) User Responsibility: You assume full responsibility for your use of GigHelper's tools and services, including compliance with all applicable laws and regulations in your jurisdiction.
11. Dispute Resolution
All disputes arising under these Terms of Service will be governed by the laws of São Paulo, Brazil. Any claims or legal actions must be resolved through mediation or arbitration, as determined by GigHelper.
- Mediation: In the event of a dispute, the parties agree to first attempt to resolve it through mediation with a neutral mediator. The mediation can be conducted in São Paulo, Brazil, or at another location or online platform agreed upon by both parties. The costs of mediation shall be shared equally.
- Arbitration: If mediation does not lead to a resolution, the dispute will be submitted to binding arbitration. The arbitration can occur in São Paulo, Brazil, or at another agreed-upon location or online platform, in accordance with the rules of the Brazilian Arbitration Act. The arbitrator's decision will be final and enforceable in any court of competent jurisdiction.
12. Modifications to Terms
GigHelper reserves the right to modify these Terms of Service at any time. Changes will be immediately posted in our website. Continued use of our services constitutes acceptance of any modified terms.
